Terms and Conditions - Positive Throttle

Welcome to Positive Throttle. This document outlines the binding Terms and Conditions for all our services. By making a booking or purchasing a service from Positive Throttle ("we", "us", "our"), you ("the participant", "you") agree to these terms in their entirety.
1. Services
Positive Throttle provides high-quality motorcycle experiences, including:
One-on-One Rider Coaching (Flat Track and Road Circuit)
Dirt Bike Ride Day + Coaching
Track-Prepared Motorcycle Hire
Combined Hire and Coaching Packages
NDIS Support Programs
2. Booking, Payment & Cancellation Policy
Booking Confirmation: All bookings must be pre-paid to be confirmed. Your spot is not guaranteed until full payment has been received.
Strict No Refund Policy: Positive Throttle has a strict no refund policy. We do not provide refunds for any reason, including but not limited to: change of mind, work or family commitments, health issues, personal motorcycle mechanical problems, or your decision not to ride due to weather.
Rescheduling & Credits:
More than 7 days from the event date: You may request to reschedule your booking. A rescheduling fee of $50.00 will be charged. The remaining balance will be held as a credit.
Within 7 days of the event date: No cancellations, rescheduling, or credits are permitted. Your booking will be forfeited in full.
Credit Validity: All issued credits are valid for a period of 12 months from the date of the original booking and are non-transferable.
Participant Substitution:
You may arrange for a suitably experienced person to take your place. You must notify us via email at least 48 hours prior to the event, providing the new participant's full name, email, phone number, and riding history.
3. Weather Policy
All our events, including coaching and hire bike days, proceed regardless of weather (rain or shine).
It is the participant's sole responsibility to make their own assessment of the conditions and to ride within their personal limits.
If you choose not to attend or participate due to the weather, your booking will be forfeited. No refund, credit, or reschedule will be offered.
In the rare event that track management or officials cancel the entire day due to extreme weather or unsafe conditions, we will provide you with a 12-month credit for your booking.
4. Rider Safety & Equipment
Mandatory Riding Gear:
Road Circuit (Coaching/Hire): A full-length, one-piece or two-piece zip-together leather suit, a compliant full-face helmet, full-length motorcycle-specific boots, and motorcycle gloves are mandatory.
Flat Track Coaching: Approved motocross-style helmet, boots, gloves, and protective riding gear are mandatory.
It is your responsibility to ensure your gear is in safe, usable condition. Failure to present with the correct gear will result in forfeiture of your booking.
Licence & Age:
Licence: You must hold a valid motorcycle licence or a current Motorcycling Australia (MA) licence. If you do not hold a current MA licence, a one-day MA licence can be purchased from us on the day of the event for a fee of $40.
Age - Road Days: For road circuit track days (coaching or hire), participants must meet the minimum age requirement set by the specific track day provider (e.g., Phillip Island Ride Days, Champion's Ride Days).
Age - Flat Track: For flat track coaching at our private facility, there is no minimum age requirement. Suitability is based on rider ability and confidence, to be assessed by our coaching staff.
5. Hire Bike Conditions
Rider Responsibility: The hire motorcycle is your responsibility for the entire duration of your booking.
Road Bike Crash Damage: You are liable for the cost of any and all damage to the road hire motorcycle sustained while in your care. A damage bond of $1,000 AUD will be taken at the start of the day via a credit card pre-authorisation. The cost of repairs will be deducted from this bond. If the damage exceeds the bond amount, you agree to pay the outstanding balance.
Flat Track Bike Crash Damage: For flat track hire bikes, no bond is required. However, you are fully liable for the cost of any and all parts required to repair damage caused to the motorcycle while in your care. An invoice for the cost of parts will be issued to you for payment after the event.
6. Coaching & NDIS Programs
Assumption of Risk: You acknowledge that motorcycle riding is an inherently dangerous activity that can result in serious injury or death. You agree to follow all instructions from your coach, ride responsibly, and assume all risks associated with your participation.
NDIS Participants: All services provided under an NDIS plan are governed by a separate Service Agreement. This agreement will outline the specific supports, costs, and scheduling in accordance with NDIS guidelines. The terms of the Service Agreement will apply in conjunction with these general Terms and Conditions.
Track Day Bookings: For coaching services delivered at a public track day, you are responsible for securing and paying for your own spot with the relevant track day provider. Our fee covers the coaching service only.
7. Conduct
We are committed to providing a safe, respectful, and positive environment for all.
We have a zero-tolerance policy for abusive, threatening, or disrespectful behaviour towards our staff, other participants, or venue personnel.
Any participant displaying such conduct will be removed from the event immediately. Their booking will be forfeited, and we reserve the right to refuse them any future services.
8. Media
We often capture photos and videos of our events for promotional use on our website, social media, and other marketing materials.
By participating, you grant Positive Throttle permission to use your image and likeness in such media. If you do not consent to this, you must inform us in writing prior to the start of your event.
Cameras may be mounted on motorcycles only if securely fastened with appropriate mounts. All camera setups are subject to our inspection. We accept no responsibility for lost or damaged equipment. Cameras are not permitted to be attached to the rider's body or helmet.
